By creating an account, accepting these Terms, or using Unwind, you agree to these Terms and acknowledge our Privacy Policy.What Unwind provides
These Terms of Service (“Terms”) are a binding agreement between you and Elowen Works (“Elowen Works,” “we,” “us,” or “our”), governing your use of the Unwind mobile app, website, and related services (together, the “Service”). If you do not agree to these Terms, do not use the Service.
Unwind is a private photo ritual for small groups. Members join invite-only circles, respond to daily prompts with photos and captions, and view the circle’s contributions at the scheduled reveal. The Service may also provide memories, reactions, comments, online-presence indicators, notifications, and user-directed collage sharing.
We may add, change, suspend, or discontinue features. We will give reasonable notice when a change materially reduces the core Service, where practical or legally required.
Eligibility
You must be at least 13 years old and at least the minimum age required to consent to an online service in your country. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf where required.
You may not use the Service if doing so is prohibited by law or if we previously terminated your account for a serious or repeated violation.
Your account
You must provide accurate information, keep it reasonably current, safeguard your password and devices, and promptly notify us at farish@elowenworks.com of suspected unauthorized access. You are responsible for activity under your account unless it results from our breach of duty.
You may use email and password or an available third-party sign-in method. Your use of a third-party sign-in service may also be governed by that provider’s terms.
You may belong to multiple circles, but each account is personal to you. Do not sell, transfer, or share account access.
Circles, invites, and privacy
Circle content is intended only for active members of that circle, but no sharing system can guarantee confidentiality. A person with a valid invite code may be able to join until the code is changed, the circle is full, or access is disabled. Circle owners can manage membership and settings. Members may save, screenshot, copy, or redistribute content despite these Terms or product controls.
You agree to:
- share invite codes only with people you intend to admit;
- respect the privacy and choices of other members;
- obtain any permission needed before capturing, uploading, or sharing another person’s image or information; and
- avoid sharing another member’s content outside the circle without their permission.
When you use the collage-sharing feature, you direct your device to export the displayed content to a destination you select. You are responsible for that external sharing.
Your content
“User Content” means photos, profile images, captions, comments, reactions, names, and other material you submit to the Service. You retain ownership of your User Content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical purposes—such as compression, resizing, backup, and display—transmit, and show your User Content only as needed to operate, secure, improve, and provide the Service, comply with law, and enforce these Terms. This license ends when the User Content is deleted from our active systems, subject to reasonable backup, legal, safety, and technical retention.
You represent that you have the rights and permissions needed to submit your User Content and allow us to use it as described here. You remain responsible for it. We do not claim ownership of it and do not use private User Content in advertising.
Feedback and product suggestions are voluntary. You allow us to use them without restriction or payment, provided we do not publicly identify you without permission.
Acceptable use
Do not use the Service to:
- violate any law or another person’s privacy, publicity, intellectual-property, or other rights;
- post or share content that is unlawful, threatening, harassing, hateful, exploitative, sexually abusive, or that depicts sexual content involving minors;
- bully, stalk, impersonate, deceive, dox, or threaten another person;
- distribute malware, spam, scams, or unauthorized advertising;
- gain unauthorized access to accounts, circles, systems, invite codes, or data;
- scrape, probe, reverse engineer, bypass access controls or rate limits, or interfere with the Service, except where applicable law expressly permits the activity despite this restriction;
- use another person’s content or the Service to train an artificial-intelligence model without all required rights and permissions; or
- encourage or help anyone do any of the above.
Do not capture or upload highly sensitive information unless every affected person understands and accepts the risks. If you encounter content or conduct that may violate these Terms, report it to farish@elowenworks.com. If someone is in immediate danger, contact local emergency services.
Moderation and enforcement
We may investigate reports and use proportionate measures including removing content, changing or revoking invites, limiting features, removing a member from a circle, suspending or terminating an account, preserving relevant evidence, or notifying authorities where reasonably necessary. We are not obligated to monitor every circle or item of User Content, and our decision not to act in one instance does not waive our right to act later.
Where appropriate, we will consider context, severity, recurrence, user safety, and available evidence. You may appeal an account or content enforcement decision by contacting farish@elowenworks.com. We may decline to provide details that would compromise another person’s privacy, safety, our systems, or an investigation.
Our intellectual property
The Service—including its software, visual design, branding, prompts, and non-user content—is owned by us or our licensors and protected by law. Subject to these Terms, we give you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the app for its intended purpose.
Except as allowed by law, you may not copy, sell, license, distribute, modify, create derivative works from, or commercially exploit the Service or our intellectual property without written permission. “Unwind,” “Elowen Works,” associated logos, and trade dress may be our trademarks or those of our licensors.
Copyright complaints
If you believe content on the Service infringes your copyright or other intellectual-property rights, email farish@elowenworks.com with a notice identifying the protected work, the allegedly infringing material and its location, your contact details, a good-faith statement explaining the issue, and any declaration or signature required by applicable law. We may remove material and take action against repeat infringers where appropriate.
Notifications, communications, and third-party services
If you enable notifications, we may send operational alerts about prompts, reveals, submissions, reactions, comments, and circle activity. You can control notifications through your device settings.
The Service depends on or links to third-party platforms and services, such as Apple, Expo, mobile operating systems, app stores, hosting providers, and apps you select through the share sheet. We do not control third-party services, and their separate terms and policies apply. We are not responsible for a third party’s acts or content, except where the law provides otherwise.
No fees in the current version
The current version of Unwind does not offer paid subscriptions or in-app purchases. If we introduce paid features, we will disclose the price, billing terms, renewal and cancellation rules, and any additional terms before you purchase.
Service availability and beta features
The Service may occasionally be unavailable because of maintenance, outages, network conditions, security events, or circumstances outside our reasonable control. Features may be identified as beta, preview, or experimental and may be less reliable or change more often.
You are responsible for keeping copies of content you cannot afford to lose. Unwind is not an archival or emergency-communication service.
Termination and account deletion
You may stop using the Service at any time. You can request deletion through Profile → Delete account, either immediately with a fresh-sign-in confirmation or after a 30-day recovery period.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, or if we are required to do so by law. Where reasonable, we will give notice and an opportunity to address the issue, but we may act immediately to protect users, third parties, or the Service.
On termination, your license to use the Service ends. Sections that by their nature should survive—including ownership, disclaimers, liability limits, indemnity where applicable, disputes, and general terms—will survive. Our handling of deleted information is described in the Privacy Policy.
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not promise that it will always be secure, uninterrupted, error-free, or that content will never be lost or disclosed by another member. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment to the extent the law permits.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded, including applicable consumer guarantees.
Limitation of liability
To the maximum extent permitted by law, neither Elowen Works nor its owners, personnel, affiliates, or suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities, arising from the Service or these Terms.
To the maximum extent permitted by law, our total liability for all claims relating to the Service or these Terms will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited, which may include liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of mandatory consumer rights.
Indemnity
To the extent permitted by law, if you use the Service on behalf of a business or organization, that entity will defend and indemnify us against third-party claims arising from its unlawful User Content, misuse of the Service, or material breach of these Terms. This section does not require an individual consumer to indemnify us where prohibited by law.
Governing law and disputes
These Terms are governed by applicable law, without limiting any mandatory consumer protections that apply where you live. Courts with jurisdiction under applicable law may hear disputes relating to these Terms.
Before filing a formal claim, you and we agree to try in good faith for 30 days to resolve the dispute by written notice sent to farish@elowenworks.com. This does not prevent either party from seeking urgent injunctive relief or using a small-claims or consumer tribunal where eligible. Nothing in this section limits rights or remedies that cannot be waived under applicable consumer law.
Changes to these Terms
We may update these Terms to reflect changes in the Service, law, security needs, or our business. We will post the updated Terms and change the effective date. If changes materially affect your rights, we will provide reasonable advance notice where required. Your continued use after the changes take effect means you accept the updated Terms; if you do not agree, you must stop using the Service and may delete your account.
General terms
If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, or asset transfer, subject to applicable law.
These Terms, the Privacy Policy, and any additional terms presented for a feature form the entire agreement about the Service.
